Before you start
These terms cover your use of Steadylending. Sections 21 and 22 matter most: they ask any dispute between us to go to individual arbitration rather than court, and they rule out class actions. You can opt out of arbitration, as section 21 explains.
1. Your agreement with us
Using this website, or sending a request through it, means you accept these terms, which form a contract between you and Steadylending (called "we", "us" or "our" below). Please leave the website if you'd rather not accept them. From time to time we may update the terms; the new version goes live on this page with a fresh "last updated" date and covers any use from then on, while a request you sent earlier stays under the version in force when you sent it. A quick look now and then keeps you up to date.
2. Who the service is for
You can use Steadylending if you're a United States resident aged 18 or over (or older, where your state sets a higher age of majority) and you have the legal capacity to sign a contract. Lenders in our network typically look for steady income and a bank account held in your name, so you'll need both. Every request has to be your own; sending one for another person isn't allowed.
3. Permission to verify and to pull reports
Sending a request gives us, along with the lenders and providers in our network, your go-ahead to confirm the details you've entered and to get information about you from consumer reporting agencies and similar sources. Checks like these may cover who you are, what you earn and the bank account you name. Our own search for a match relies on a soft inquiry, which leaves your credit score untouched. Should you move forward with a lender, it may run a check of its own, and that one may be a hard inquiry. Our Credit Authorization walks through all of this step by step.
4. What Steadylending does
We run a matching service that costs you nothing. You fill in one personal loan request, and we pass it along to lenders and providers in our network, each of which weighs up whether it may be able to offer you something. A request is not a promise of a match, a call or an offer, and no particular result can be assured. Some lenders don't serve every state, and each one makes its own call on whether to reply.
5. Where our money comes from
You're never billed by us. Instead, lenders and providers in our network may pay us, either for receiving a request or when a request turns into a loan. Those payments can affect which lender gets your request first and the order in which any offers appear. Our network doesn't include every lender or product on the market, and a lender's place in it shouldn't be read as our endorsement.
6. We're not a lender, broker or agent
Steadylending does not lend, fund loans, make credit decisions, or arrange or broker credit. Nor do we act as an agent or representative for you or for any lender, and nothing here is financial, legal or tax advice. If a loan is offered, it's a matter between you and that lender, on terms the lender alone chooses. Take your time with the lender's agreement, and put any questions to the lender before you sign.
A lender in our network may be tribally owned and operate under the law of a Native American tribe. With a lender like that, the law governing the loan, the agreement itself and the routes for settling a dispute may differ from what a state-licensed lender uses, and some state consumer protections may not reach you. Its own agreement has to spell those differences out, so read it closely before deciding anything.
7. Other offers you might see
When no lender picks up your request, we or a partner may point you to other products or services you might find useful, such as credit tools or money education. Looking at them is entirely optional, and anything you decide to sign up for runs under the terms of the company that provides it.
8. Passing on your details
Your request asks us to hand its details to lenders, other providers and the partners who help us operate, so that they can review it and get in touch with you about it. They may hold on to and use that information under their own privacy policies, whether or not you accept an offer. Our Privacy Policy is the place to read about what we gather, who it goes to and the options you have.
9. Paperwork, done electronically
You agree to receive notices, disclosures and other messages from us electronically, either by email or on this website, and you accept that they satisfy any rule requiring them in writing. Clicking a button or checking a box on this website works as your electronic signature. To get these messages you'll need an internet-connected device, an up-to-date browser and an email address you can use. You may take back this consent whenever you like by emailing us, though we might not be able to carry on with your request afterwards. If you'd like a paper copy of a notice, just email and ask.
10. Phone calls, texts and emails
By sending a request and agreeing to be contacted, you permit us, lenders in our network and our partners to reach you about the request and related products by call, text and email at the number and address you gave. Those calls and texts may use automatic dialling equipment or prerecorded or artificial voices. Agreeing to this is not required to buy anything. Message and data rates may apply. Want the messages to stop? Text back STOP, or use the Unsubscribe page on this site. The TCPA Disclosure has more detail.
11. Who owns the website's content
All text, graphics, illustrations, layout and other material on this website belong to us or our licensors and are protected by copyright, trademark and related laws. Feel free to view or print pages for personal, non-commercial use. For anything beyond that, such as copying, adapting, republishing or selling it, please get our written say-so first.
12. Privacy
Our Privacy Policy, which is part of these terms, covers how we gather, use, share and look after your personal information. If you live in California, our Do Not Sell or Share My Information page describes your rights.
13. What you're confirming
Each time you use the website, you're telling us that:
- the information you give is accurate, complete and about you, and you'll update us if it changes while your request is still open;
- you satisfy everything listed in section 2;
- you own, or have permission to use, the phone number and email address you enter;
- you won't use the website to break the law or deceive anyone, and won't try to interfere with it, overload it or get into it without permission; and
- you won't scrape, harvest or copy the website's content with bots or other automated means.
14. No promises about the website
We aim to keep the website correct and running smoothly, yet it comes to you "as is" and "as available". As far as the law permits, we give no warranty of any kind, stated or implied, including any warranty that the website will suit your purpose, stay online, be secure or be error-free, or that a lender will reply or make you an offer. We also give no warranty about the terms, quality or fit of any loan, product or service offered to you by a lender or provider.
15. How far our liability goes
As far as the law permits, we aren't liable for indirect, incidental, special, consequential or punitive damages of any sort connected with the website, your request or anything between you and a lender or provider, even where someone warned us such damages could happen. For any claim about the website or the service, the most we'll owe you is the amount you paid us for the service, which is nothing. A few states don't permit some of these limits, in which case parts of this section may not cover you.
16. Indemnity
You agree to protect and reimburse us, together with our owners, employees and partners, against any claim, loss, cost or reasonable attorney's fee that arises because you broke these terms, gave us untrue information or used the website unlawfully.
17. Errors, outages and delays
We can't be held responsible when something beyond our reasonable control causes a delay or failure, such as a power cut, an internet outage, a fault in a lender's or partner's systems, or a typo in the details you entered. When we find an error on the website we'll fix it, and we may alter, suspend or withdraw any part of the website at any time without telling you first.
18. Other companies' websites
Links on this website, and any offers that follow a request, may take you to sites owned by lenders and other businesses. Other people run those sites: we don't manage them and can't answer for their content, their terms or their handling of your data. Whether you visit them is your choice, and their own terms and privacy policies will govern your visit.
19. Let us know before making a claim
If you want to bring an arbitration or other claim against us, please first email [email protected] setting out your name, your contact details, the issue and the outcome you're looking for. We'll look at it in good faith and try to settle things between us. Should 60 days pass after we receive your notice without a resolution, either side may begin arbitration under section 21.
20. Releasing us from lender disputes
Loans and other products come from the lender or provider that offers them, and not from Steadylending. As far as the law permits, you give up any claims, demands or damages against us that stem from a disagreement between you and a lender or provider. If you live in California, you also give up the protection of California Civil Code section 1542, whose text is: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
21. Binding individual arbitration
This section changes how disputes are handled, so please go through it with care: under it, neither of us can ask a judge or a jury to decide a dispute.
Any claim or dispute between you and us that arises out of or relates to these terms, the website or the service, including any question about whether this section applies or is enforceable, will be resolved by binding arbitration between the two of us individually, and not in a court. A single arbitrator will hear it, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. It's the Federal Arbitration Act, not state arbitration law, that governs this agreement to arbitrate. Hearings will be held in California, or by phone or video call if that suits you better. Apart from the amount you would have paid to file the same claim in court, we will cover AAA filing, administration and arbitrator fees, unless the arbitrator decides your claim was made in bad faith. Whatever individual relief a court could order, the arbitrator can order too, and a court that has jurisdiction can turn the arbitrator's award into a judgment.
Small claims court stays open to both of us for an individual claim, so long as the case is heard and kept in that court. To opt out of this arbitration agreement, email us within 30 days of the first time you use the website, giving your name and saying plainly that you wish to opt out. Everything else in these terms keeps applying to you after you opt out.
22. Class-action and jury waiver
Claims between you and us may be brought only on an individual basis, never as a plaintiff or class member in a class, collective, combined or representative proceeding. No arbitrator may join the claims of different people or oversee any class or representative proceeding. If a court holds this waiver unenforceable for a given claim, that claim will go to court rather than arbitration, while sections 21 and 22 continue to govern all other claims. On top of that, you and we each waive the right to have a jury hear any claim.
23. Copyright notices (DMCA)
We take intellectual property seriously. If you think material on this website infringes a copyright you own or represent, email [email protected] with the information the Digital Millennium Copyright Act requires: a description of the copyrighted work; a description of the material you say infringes it and where on the website it appears; your address, phone number and email; a statement of your good-faith belief that the use is not authorised by the owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you own the copyright or may act for the owner; and your physical or electronic signature.
24. California users
California Civil Code section 1789.3 gives California users the right to this notice. You pay nothing for our service. If something about it bothers you, or you have a question, write to [email protected]. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
25. Entire agreement
Together with our Privacy Policy, our TCPA Disclosure and the other documents referred to here, these terms make up everything you and we have agreed about the website and the service, and they take the place of any earlier arrangement. If you sign for a loan, that loan agreement is a separate contract between you and the lender.
26. General provisions
The laws of the State of California govern these terms, setting aside its conflict-of-law principles, with the Federal Arbitration Act governing section 21. Anything that doesn't go to arbitration will be decided by the state or federal courts sitting in California, and you and we submit to those courts' jurisdiction. Should a court find any provision unenforceable, the remaining provisions continue to apply. A delay by us in enforcing any provision doesn't waive our right to enforce it afterwards. Your rights under these terms can't be assigned to anyone else, though ours may be. Section titles are for convenience only and don't affect how the terms are read.
27. Questions about these terms
We're happy to help. Send any question about these terms to [email protected].
